Terms and Conditions

Each time a Guest confirms a booking of Villa Jintaleela (the “Villa”) through www.villajintaleela.com, a Rental Contract is entered into between the villa owner (the “Villa Owner”) and the guest in whose name the booking is made (the “Guest”) for the agreed period (“Rental Period”). When a Guest books the Villa through www.villajintaleela.com or makes a payment invoiced by Villa Jintaleela, the Guest is deemed to have agreed to these terms and conditions, and for personal data to be processed by  the villa management ( the “Villa Management”)  with regards to the Rental Contract. The Rental Contract is not effective until the Villa Management has confirmed the Guest’s booking in writing.

Payment

When you make a booking request, the appropriate deposit payment must be made for the reservation to be confirmed. If the required deposit payment is not received, Villa Management reserves the right to void the Guest’s booking request. Unless otherwise agreed in writing between Guest and Villa Management the following deposit payment schedule applies:

  • For arrivals more than 30 days after the date of the booking request – a deposit of 30% of the total rental amount is payable

  • If the arrival date is within 30 days of the date of the booking request – the total rental amount is payable as a deposit

Where a 30% deposit applies to the booking, the Guest must pay the remaining 70% balance at least 30 days before the scheduled arrival date (or such earlier date stated in the booking confirmation for peak season bookings), otherwise the booking may be cancelled without refund subject to our Cancellation terms below.

Additional Services and Costs

35 kWh of electricity per day, mains, water, cleaning and garden supplies are included in rental rates.  Excess electricity consumption is charged at 10 THB/unit (kWh). Villa Management may charge a deposit for additional services requested by the Guest (e.g. delivery of food, goods or services or provision of additional staff such as babysitters and private chefs). The Guest authorizes the Villa Management to charge the Guest's credit card on file with any outstanding amount payable for such services not paid at check-out.

Reservation Confirmation

Once the full payment is received, the Guest shall be sent the Villa address, contact details of the Villa Management, transfer arrangements, and directions to the Villa. The passports of all guests needs to be presented upon arrival for check-in.

Arrival / Departure Times

Standard check-in and check-out times for the Villa are 3pm (check-in) and 11 am (check-out) respectively. The Villa Management will accommodate the Guest’s actual arrival and departure times, subject to availability. Please notify the Villa Management of any change in your arrival or departure schedule for us to be able to accommodate a change where possible. The Guest must leave by the time specified on the departure date. The Guest agrees there shall be no holding over or late departure without prior approval by the Villa Management. Any unauthorized holding over by Guest shall be subject to a charge of 1 and 1/2 times the daily prorated rent ("Holdover Rate"), plus any additional damages incurred including, but not limited to, the cost of alternative housing for other guests displaced by Guest's holding over and the Guest authorizes the Villa Management to charge the Guest's credit card on file with such additional amounts payable.

Security Deposit

A security deposit of THB 20,000 will be payable immediately upon arrival at the Villa. Access to the Villa may be refused if the security deposit is not paid in full. If a cash payment of the security deposit is not made upon check-in, the Guest authorizes the Villa Management to charge the Guest's credit card on file with the equivalent amount of THB 20,000. The security deposit will normally be refunded within 5 - 10 days after the end of the rental period after deducting all additional expenses incurred on the Guest’s behalf (e.g. charges for food, goods, services, and additional staff such as babysitters and private chefs, which have not been directly paid by the Guest). As well as the cost of replacement or repair of any loss or damage to the Villa or its surrounds or contents or removal of dirt or other mess requiring excessive cleaning caused during the Rental Period. If this cost cannot be reasonably determined prior to the Guest’s departure, the Villa Management is entitled to withhold a reasonable estimate from the Guest’s security deposit and will return any balance to the Guest as soon as possible after the actual cost has been determined.

Damage or Losses

Please leave the Villa and all its contents in good order and an acceptably clean condition. Malicious or accidental damage caused by the Guest, other guests or invitee/s, will be charged for at the full replacement cost of the damaged item and deducted from the security deposit. In cases of excessive or unacceptable loss or damage at any time during the Rental Period, Villa Management may require the Guest and their party, including visitors, to vacate the Villa immediately, without compensation or refund.

Access

The Villa and its facilities are available for the Guest’s full enjoyment during the duration of stay. However Villa Management or other staff and contractors may need access to the Villa from time to time (e.g. for maintenance of the house, garden, swimming pool, utilities and services, or for providing additional services requested by the Guest, etc.). You are required to give them reasonable access to the Villa for these purposes.

Number of Guests

Only the number of persons stipulated in the booking confirmation may reside at the property as guests.  The total number of guests must be notified to villa management no later than 24 hours prior to their arrival. Children are counted in total occupancy, unless they are under the age of two and normally sleep in a crib. Under no circumstances will visitors (unregistered guests) be allowed to stay the night. Unregistered persons will be asked to vacate the property and additional charges of THB 8,000 per person per night will apply for any unregistered guest found to be staying at the Villa. Any misrepresentation regarding the guests occupying the villa (including false statements regarding the age of the guests), overcrowding, or sub-letting of the villa will result in both the forfeiture of all monies paid (including all fees) to the Homeowner and immediate, expedited eviction.

Use of Villa

All bookings are assumed to be for normal holidaying purposes only, and the Guest agrees that the use of the Villa will be limited to this purpose unless otherwise confirmed in writing. If the Guest is planning to hold an event such as a wedding or a party that involves a larger number of people than stipulated in the booking confirmation, or if the Guest is planning to use the Villa for a purpose other than a holiday, please communicate this to Villa Management at the time of booking, as special approval or arrangements is required. Bachelors or bachelorette parties (also called hens, stags and bucks parties), may not be organized in the villa. Depending on the nature of the event, a surcharge and/or additional security deposit may be required, which will be agreed to and confirmed in writing before confirming the reservation.  Any guest hosting events without prior written approval will forfeit the rental and be asked to leave immediately, and agree to be charged a minimum of THB 30,000 per night in addition to their rental fee for allowing extra guests on the premises.

Conduct and Due Care

Illegal or immoral activities including gambling, prostitution, prohibited drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons are all strictly prohibited. Smoking and pets are generally prohibited in all villa rooms. A THB 8,000 fee for deep cleaning will be charged in case of any violations. The penalty will be applied each time any guest(s) is found smoking inside the  Villa, or if any evidence of smoking or a pet is found in any villa room.

Illegal activities, inappropriate behavior, noise complaints, property abuse, disabling of security or safety equipment such as smoke detectors or violation of any of the above villa rules will result in the Villa Management requesting the guests to leave immediately without any refund.

The Guest is responsible for the behavior of all guests staying at the Villa, as well as visitors to the Villa during the Rental Period. Should any guest(s) or visitor(s) not behave in a suitable manner, Villa Management may, in their absolute discretion, require the Guest, their party and/or visitor(s) to leave the premises and/or vacate the Villa immediately, without compensation or refund.

In the interest of safety, due care should be taken at the Villa at all times, especially with children. Suitable supervision should be given around pools, beaches and roads, and when using the Villa’s facilities. The Guest explicitly acknowledges that the pool area is not fenced and the sala and rear stairs are insufficiently fenced for small children and children must therefore be under direct supervision of an adult at all times when staying at the villa. Also, outdoor areas may become wet and slippery due to poor weather or spray from the pool, Please be cautious and avoid running and please do not use towels to remove make-up or sunbathing oils or to wipe up liquids.

The pool may need to be closed down for extra cleaning for 2-3 days, if excess suntan lotion oil is found in the water and a THB 2,000 cleaning fee will be deducted from the security deposit, if excessive oil, broken glass or dirt caused by villa guests is encountered in the pool.

Valuables and Security

Guests are responsible for all their valuables and personal items. Neither the Villa Owner or Villa Management accepts any responsibility for loss of or damage to Guest property. The Guest is responsible for the Villa during the Rental Period and must ensure that all windows and doors as well as the automated gate, the entrance door and the beach gate are locked securely when not on the premises. Any act or omission by the Guest, their party and/or visitors which may negate or prejudice the Villa’s insurance policy and/or results in loss or damage is the Guest’s responsibility.

Price Fluctuation

Once a booking is confirmed, the price of the reservation is fully guaranteed, even if there are revised rental rates posted on this website thereafter. In return for this commitment, no refunds will be made for any exchange rate fluctuation that may otherwise reduce the rental cost.

Villa management reserves the right to impose any taxes or other charges which may be implemented by a government or other regulatory body, which were unknown at the time of publishing.  Villa management will tell the Guest promptly in the unlikely event that it becomes aware of any additional taxes or charges that will apply to the Guest’s booking.

Cancellations

In the event that the Guest cancels a confirmed booking, the following cancellation fees will generally apply:

  • 30% of the total rental amount will be forfeited if the cancellation is made more than 30 days before the start of the rental period

  • 100% of the total rental amount will be forfeited if the cancellation is made between 1 and 29 days before the start of the rental period

  • For no-show: 100% of the total rental amount will be forfeited

The applicable amount will be deducted from the deposit and moneys paid, and Villa Management will refund any remaining balance to the Guest.

We will be happy to arrange additional services such as private chef or excursions upon request. We recommend that any extra services are booked well in advance to avoid disappointment. All quoted charges for extra services must be prepaid in advance.If you decide to cancel, please do it 72 hours before the booked date. There will be a 50% cancellation fee for cancellation of services cancelled less than 48 hours before the booked date. There is no refund for services rendered.

Amendments

Villa Management will do its best to accommodate reasonable amendments, but kindly be aware that some changes may not be possible. Charges may also apply. Note: Shortening of stay for any reason is considered as a cancellation.

In the unlikely event that the Guest is unable to stay at the Villa for any reason (including force majeure), Villa Management reserves the right to transfer the Guest and their party to an alternative villa of similar type and value, in consultation with the Guest. If the price of the substituted villa is less than the original booking, the difference will be reimbursed back. If the price of the substituted villa is higher than the original booking, the difference may be charged to the Guest. If, however, no alternative of similar type and value is available and/or no agreement can be reached between the Guest and Villa Management, then either Villa Management or the Guest may opt to cancel the booking and this Rental Contract. In that event, Villa Management will refund the paid amount to the Guest, without scope for further compensation.
 

Complaints

Every attempt will be made for the Guest to have an enjoyable stay. If you have a problem during the Rental Period, please inform Villa Management and we will try to put things right. For complaints to be addressed, the Guest must communicate any problem whilst on location. If no complaint is reported during the Rental Period, Villa Management will assume that the Villa was to the Guest’s satisfaction and no complaint will be entertained later.

Villa Description

The description and surrounding location of the Villa are provided in good faith and in the belief that they are accurate based on the latest information received. However, Villa Management cannot be held responsible for any last-minute modifications to the Villa or inaccuracies. Where Villa Management or this website refers to descriptions, assessments and/or reviews of the Villa either by Villa Management or by third parties, these ratings are for information purposes only and Villa Owner and Villa Management will not be held responsible for any reliance placed on these ratings.

Disclaimers

The Villa Management and the Villa Owner do not accept any responsibility or liability for:

  • any physical injury, sickness, death, loss, damage, inconvenience or additional expenses incurred by the Guest, their party or visitors regardless of the cause;

  • any vehicle or the contents of any vehicle used, hired or engaged by the Guest or their party during the Rental Period;

  • inability of the Guest or any member of the Guest’s party to enter the location of the Villa or stay at the Villa for all or part of the Rental Period as a result of failure to obtain appropriate travel or visa documentation, cancellation or amendments to travel arrangements or the missing of flights or travel connections; and/or

  • strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any technical, structural, electrical, plumbing or other problems or difficulties with the Villa which make it unsafe or unusable, or any other circumstances which amount to ‘force majeure’ or Acts of God, or other events beyond the Villa Owner’s control.

In no case will the Villa Owner or the Villa Management individually or collectively be liable to make any payment or give any refund or compensation of any amount over and above the total rental amount paid.

Jurisdiction

This agreement will be governed by the laws of Thailand. By making a booking request, the Guest agrees that these terms and conditions have been read, understood and have been accepted and agreed to without reservation and without exception. If any of the conditions of this Rental Contract are or become or are deemed to be invalid, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested.
